Agreement to Terms

Madam is a social platform where Black and Brown women discover, belong, and build community together. By accessing or using the Madam website and services (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these terms, you may not access the Service.

Use License

Permission is granted to temporarily access the materials on Madam’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

Child Safety

Madam has a zero-tolerance policy toward child sexual abuse and exploitation (CSAE). We strictly prohibit any content, behavior, or activity on the Madam platform that sexually exploits or abuses minors in any way, including but not limited to:

Any user found engaging in such conduct will have their account permanently terminated immediately. Madam will report all confirmed instances of CSAM to the National Center for Missing and Exploited Children (NCMEC) and cooperate fully with law enforcement authorities.

To report child safety concerns or CSAE content on Madam, please contact us immediately at safety@trymadam.com.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Madam and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material (“Content”). You are responsible for the Content that you post on or through the Service, including ensuring you have the necessary rights to post such Content.

By posting Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute such Content in connection with operating, promoting, and improving the Service. This license includes the right to make your Content available to other users who may also use your Content subject to these Terms (for example, when other users save or share your Content through features like “Jarring”).

You retain ownership of your Content. The license you grant us is limited to the purposes described above. You may delete your Content at any time, which will terminate this license, except that: (a) Content that has been shared by other users may remain visible but will display as from a “deleted user” or show as “unavailable”; and (b) we may retain copies for a reasonable period for backup, archival, or legal compliance purposes.

You represent and warrant that you own or have the necessary rights to post your Content and to grant the license above.

Disclaimer

The materials on Madam’s website are provided on an “as is” basis. Madam makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitations

In no event shall Madam or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Madam’s website, even if Madam or a Madam authorized representative has been notified orally or in writing of the possibility of such damage.

Beta Service

Madam is currently in beta. The Service may contain bugs, errors, and other issues. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice. We are not liable for any loss or damage resulting from your use of the beta Service.

Account Deletion and Data Retention

You may request deletion of your account at any time through the app settings or by contacting us. Upon receiving a deletion request:

If you change your mind within 30 days, you may contact us to cancel the deletion request and restore your account.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. The Account Deletion and Data Retention section above describes how your data will be handled.

Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Madam operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
